Eligible offenses

Pretrial assessment programs that release individuals prior to arraignment are limited to cases that are not deemed ineligible by the penal code. Serious and violent offenses require court intervention prior to release from jail. For example, drug offenses are eligible for pretrial release before an arraignment, while an assault with a deadly weapon offense requires appearing before a judge at arraignment before being released from custody.
