Mitigating or aggravating circumstances

Mitigating circumstances are facts or circumstances that lessen the severity or culpability of the criminal act. Aggravating circumstances increase the severity or culpability of the criminal act. These circumstances are discussed in the pre-sentence investigation report provided to the court. The probation officer takes these circumstances into consideration when making a recommendation to the court for the sentence of an individual.
